The United States Court of Appeals for the District of Columbia Circuit has reinstated a lawsuit against several pharmaceutical and medical-device companies, regarding their activities in Iraq.
The original lawsuit claimed that the companies knowingly financed terrorist attacks in Iraq following the overthrow of Saddam Hussein, through their support to the Ministry of Health and its import subsidiary, Kimadia. This lawsuit was dismissed in 2020.
Last week, the Court of Appeals reversed that decision, allowing the case to go ahead.
The original defendants were listed as:
AstraZeneca UK Limited, AstraZeneca Pharmaceuticals LP, GE Healthcare USA Holding LLC, GE Medical Systems Information Technologies, Inc., GE Medical Systems Information Technologies GmbH, Johnson & Johnson, Cilag GmbH International, Ethicon Endo-Surgery, LLC, Ethicon, Inc., Janssen Ortho LLC, Janssen Pharmaceutica N.V., Johnson & Johnson (Middle East) Inc., Ortho Biologics LLC, Pfizer Inc., Pfizer Enterprises SARL, Pfizer Pharmaceuticals LLC, Pharmacia & Upjohn Company LLC, Wyeth Pharmaceuticals Inc., F. Hoffman-La Roche Ltd., Genentech, Inc., and Hoffman-La Roche Inc.
