Tribunal Appointed in Agility Arbitration Case

An arbitration tribunal has been appointed in the case of Agility Public Warehousing Company K.S.C. v. Republic of Iraq (ICSID Case No. ARB/17/7).

Its members are:

  • Sarah Grimmer (New Zealand), President, appointed by agreement of the Parties;
  • Stephen L. Drymer (Canadian), appointed by Claimant; and
  • Dr. August Reinisch (Austrian), appointed by Respondent.

The case is being heard by the World Bank's International Centre for Settlement of Investment Disputes (ICSID).

ICSID had previously denied Agility's claims that Iraqi officials expropriated $380 million it had invested in Iraqi telecom company Korek Telecom.

Agility resubmitted its claim to ICSID in July 2024, following successes at the Lebanese Arbitration Center, and at the International Court of Arbitration of the International Chamber of Commerce (ICC).

The claimants are represented by Meysan Partners of Kuwait, and by US-based Skadden, Arps, Slate, Meagher & Flom, while Debevoise & Plimpton of New York represents the defendants.
