Iraq Regulator Cancels Korek Telecom Settlement Contract

By John Lee.

Iraq's Communications and Media Commission (CMC) has cancelled its settlement contract with Korek Telecom and ordered a halt to all the company's operations, citing repeated failures to meet its contractual obligations.

In a statement, the CMC said the decision was taken under clauses 12, 13, 15 and 16 of Article Five of the settlement contract, following confirmation that Korek Telecom had breached its commitments despite being given multiple extensions and opportunities to regularise its legal and financial position.

The CMC said it will pursue all legal, regulatory and technical measures provided for under the contract and applicable laws, including action against the company's assets, in coordination with relevant national and international authorities.

The commission's Consumer Voice Department has been instructed to receive, register and follow up on complaints from Korek Telecom subscribers, and to manage the impact of the decision on customers within the applicable regulatory framework. Full legal and financial responsibility for consequences arising from the contract breach has been assigned to Korek Telecom.

The CMC called on all official and non-official bodies and members of the public not to enter into any new dealings, commitments or contracts with the company.

A statement from Korek described the decision as irresponsible, accused the CMC of lack of neutrality and a bias against the company, and said it would pursue every legal avenue to defend its rights.
