Iraq Wins in $800m Arbitration Case Against Orange

Iraq has prevailed in an international arbitration case brought by Orange against the Republic of Iraq and the Communications and Media Commission (CMC), with all of the company's claims dismissed by the International Center for Settlement of Investment Disputes (ICSID).

The Ministry of Justice said the outcome was the result of sustained legal efforts by its Legal Department, which managed the case and presented Iraq's defence before the international arbitration body. The Ministry described the result as strengthening the protection of public funds and safeguarding the rights of the state and its institutions in international legal proceedings.

The tribunal also ordered Orange to pay Iraq $10 million in legal fees and costs.

ICSID gave few details of the case [ARB/20/42], but confirmed that it had rendered its award last week. It added that the claimants were represented by Jones Day, while the respondents were represented by Debevoise & Plimpton.
