Second, the “Net” Remuneration fee
According to the concluded contracts the remuneration fees (at R-factor value=1) ranges between $6/barrel and $1.15/b giving a simple average of $2.513/b for the ten covered oilfields. This simple average is highly impacted by the two high remuneration fees for Alahdab and Badra oilfields.
But the weighted average of the remuneration fees (weighted by the plateau production of the related oilfields) declines to $1.88/b, reflecting the significance of economies of scale of the giant brown oilfields of the first bid round.
The above averages (simple and weighted) are for the gross remuneration fees; but gross remuneration fee is deductible by three factors: the income tax; the share of the State partner and third, the R-factor. Leaving the impact of the R-factor aside (because it is complex accounting and auditing process that relates to actual expenses and revenues, which the Ministry of Oil did not disclosed so far) the “Net” remuneration fee is calculated as the gross remuneration fee deducted by the income tax and the share of the State partner.
Based on the contract provisions I have calculated that every dollar Iraq pays as remuneration fee it is divided between Iraq and the IOCs at 51.25% vs. 48.75% respectively. This implies that the maximum “simple average of the Net remuneration fee” which the IOCs receive is $1.23/b and the maximum “weighted average of the Net remuneration fee” which the IOCs receive is $0.92/b. They are the maximum because they were calculated at R-factor=1, meaning that higher values for R-factor (occurring as production incresaes) would reduce the remuneration fee depending on the adopted contract of the bid round.
Therefore, our calculation produces two thresholds for net remuneration fee: $1.23 and $0.92 per every incremental barrel of oil production.
Third, the compensational curtailed production
As mentioned above the Minister of Oil said the amount of paid compensation exceeds $14.4 billion. Such payment was done to compensation the IOCs for lost income (Net remuneration fee) due to production curtailment in accordance with article 12.5 of the contract. But how accurate, or possible or justifiable this amount is?
The simple test is to estimate the volume, number of barrels, of the “curtailed production” that justify such astronomical compensation during the period 2011-2014.
Based on the two thresholds for net remuneration fee $1.23 and $0.92 mentioned above the curtailed production must have been either 11.746 billion barrels or 15.705 billion barrels!!!!.
To tolerates these volumes of curtailments the South of the country needs to have at least production capacities of 3 mbd (in 2011); 6.5mbd (in 2012); 8.9 mbd (in 2013) and 13.8 mbd (in 2014) under 11.746 billion barrels only; and much higher than these under 15.705 billion barrels of curtailed production!
Let us remember that total incremental production (to justify remuneration fee payment) during the same period was only 1.1 billion barrels. So how is it possible that the volume of curtailed production is between 11 folds to 15 folds higher than actual incremental production?
Something is seriously wrong, suspicious and scandalous.

Following my email on this matter kindly find below two feedbacks I received from the Ministry of Oil. The recent is from H.E. the Minister, Mr. Adil Abdul Mahdy (dated 4 April in Arabic) while the earlier is from Mr. Abdul Mahdy Al-Ameedi, DG, PCLD (dated 3 April, in English). Below are the “exact texts” of both feedbacks.
It appears from the feedbacks that what they called “paid compensation to the IOCs” was their (mistake by not differentiation between loss due to “production curtailment” and loss as “compensation to IOCS for remuneration fee during such curtailment”).
Hence, the $14,448,146,107, which they called “paid compensation to the IOCs” is actually composed of the following:
- $14,184,580,673 calculated lost revenues due to production curtailment for all reasons;
- $263,565,434 calculated remuneration fee as compensation to IOCs
Moreover, the Minister confirms his support to the concluded service contracts and he considers my remarks and analysis that he aims to convert them into PSCs as “baseless”
May I take this opportunity to sincerely thank both gentlemen for their very kind openness, receptivity, responsiveness and detailed information to explain the situation and clear the confusion created by their earlier not very careful statement.
That said, there are still some discrepancies between the two answers, though the major ones are cleared, as the readers will surely find out.
For transparency and public information I make this brief comment without going, for the time being, into details on the content of their feedback.

السلام عليكم ورحمة الله وبركاته
وردني عبر الايميل من جنابكم الكريم بتاريخ 3/4/2015 تحليلاً معمماً لعدد غير قليل من المختصين، يتناول بالتعليق ما سبق ان اعلنا عنه من خسارة العراق مبلغ 14.448.146.000 دولار خلال الفترة 2011-2014.. ويبدو ان خطأ قد وقع، بسبب عدم التفصيل بين الخسارة بسبب "التقليص".. والخسارة نتيجة "التعويضات" بسبب مجموع الربحية المدفوعة للمقاولين عن كميات التقليص.. فالخسارة التي تكلمنا عنها المقصود بها الامرين، كما هو واضح من الرقم المقدم، وليس امراً واحداً فقط، وهو ما اقتضى التوضيح ورفع الالتباس.
وللاستفادة من النقاش نضيف المعلومات الاتية من اجل استجلاء الارقام المطروحة. وذلك وفقاً لدراسة اعدتها الوزارة بتاريخ 23/3/2015. علماً اننا طرحنا هذا الامر في مجلس الوزراء، وتم رفع الدراسة الى السيد رئيس مجلس الوزراء ورئيس لجنة الطاقة.
1- بلغت كميات التقليص الكلية لكافة حقول جولات التراخيص منذ عام 2011 ولنهاية الفصل الرابع من عام 2014 والمصادق عليها من قبل شركة نفط الجنوب 139.834.802 برميل.
2- ليبلغ مجموع الخسارة في عوائد الحقول نتيجة التقليص في الانتاج 14.184.580.673 دولار باعتماد المعدل السنوي لسعر التصدير..
أ- 2011 مبلغ 2.871.569.009 دولار
ب- 2012 مبلغ 3.511.262.846 دولار
ت- 2013 مبلغ 4.877.024.251 دولار
ث- عام 2014 مبلغ 2.924.724.567 دولار
3- بلغ مجموع الربحية المدفوعة للمقاولين عن كميات التقليص في الانتاج 263.565.434 دولار وكالاتي:
أ- عام 2011 مبلغ 54.090.247 دولار
ب- عام 2012 مبلغ 81.477.924 دولار
ت- عام 2013 مبلغ 82.252.453 دولار
ث- عام 2014 مبلغ 45.744.811 دولار
4- ليكون مجموع الخسارة للجانب العراقي من عوائد التقليص في الانتاج وتعويضات اجور الربحية المدفوعة للمقاولين للشركات الاجنبية خلال تلك الفترة 14.448.146.107.. (وهو الرقم الذي اعلنا عنه)
5- للعلم بلغ مجموع كميات التقليص غير المتفق عليها اكثر من (94) مليون برميل، والتي تمثل مطالبات المقاولين بالتعويض عن التقليص لاسباب تشغيلية (فترة توقف الابار او انقطاع التيار الكهربائي.. الخ) ولم تحصلموافقة شركة النفط عليها، لذلك لم يتم دفع اجور ربحية عنها للمقاولين، ولم يتم احتساب هذه الكميات عند حساب خسارة العوائد الناجمة عن التقليص.
6- كميات التقليص المتفق عليها تمثل كميات التقليص لاسباب ارتفاع الخزين او سوء الاحوال الجوية والتي تمت بناء على طلب رسمي من شركة نفط الجنوب وصادقت على كمياتها ضمن محاضر مطابقة الانتاج.
7- ان تأثير التقليص المفروض على حقل الحلفاية وحقول ميسان يكون طفيفاً لانخفاض معدلات الانتاج نسبياً ولوجود سعة خزنية داخل هذه الحقول.. كما ان حقل الاحدب لا يتأثر بالتقليص وذلك كون جزء كبير من انتاج الحقل يتم ضخه الى محطات توليد الطاقة الكهربائية (الزبيدية والقدس) والمصافي بالاضافة لوجود سعة خزنية داخل الحقل.
8- بينت شركة نفط الجنوب انه تم الايعاز الى مشغل حقل غرب القرنة/ المرحلة الثانية بتقليص الانتاج ليكون 350 الف برميل/يوم بدلاً من 390 الف برميل/يوم.. والى شركة بتروجاينا مشغل حقل الحلفاية بتقليص الانتاج ليكون 50 الف برميل/يوم بدلاً من 85 الف برميل/يوم ولفترة مؤقتة بسبب انخفاض الكثافة النوعية لمزيج خام البصرة الى (27) درجة على ان يتم تعويض المقاول عن هذه الكميات مما يعني اضافة اسباب جديدة للتقليص، علماً ان الكثافة النوعية للحقلين اعلاه هي (27، 22) على التوالي.
9- لهذا كله اعلنا ان الوزارة تسعى لطرح نفطين الاول هو "البصرة الخفيف" والثاني هو "البصرة الثقيل".. وان عمليات مد الانابيب وتهيئة الخزانات ومنصات التحميل جارية على قدم وساق، وذلك كله لحماية نوعية وسمعة نفط "البصرة الخفيف" ولمنع تأثير ذلك على معدلات الانتاج والتصدير.
لهذا كله اقتضى التوضيح، وقد تجاوزنا بعض التصورات والاستنتاجات الواردة في رسالتكم والتي لا تستند على حقيقة، والادعاء اننا نسعى لتحويل عقود الخدمة الى عقود شراكة.. في وقت يعلم فيه الجميع اننا كنا من المؤيدين القلائل لعقود جولات التراخيص.. ليس لايماننا انها تخلو من النواقص والشوائب، او انها افضل اشكال العقود في كل زمان ومكان.. بل لانها الاقرب لتحقيق المصلحة العليا في اطار الواقع النفطي العراقي. ويبقى التعويل على استنهاض الجهد الوطني وتطوير قدراته وامكاناته وخبراته هو الهدف الذي به تستقيم الامور، سواء للاعتماد على النفس او لحسن التعامل والتعاون والتعاقد مع الشركات الاجنبية.

Dear Mr. Ahmed,
Before completing reading your article, I could not wait any more and would like to bring to your kind attention the real story beyond H.E. the Minister's statement, specially the first point, and I will make my clarification as follows:
1. As a compensation to the IOCs, the Ministry pays only the Remuneration Fee as $ per barrels produced and nothing else (cost recovery is not a compensation). By simple calculations you can recognize that the 14,448,146,000 $US can be paid for 4,816,048,666 produced barrels (if 3 $/Bbl is assumed as an average Fee), and this quantity of produced oil represents a daily production rate of 3,298,663 Bbls over the past four years (2011-2014) taking into account 365 days a year which does not reflect the reality and is not reasonable.
2. The aforementioned sum of money (14,448,146,000) was calculated as the revenue of the Ministry's lost production due to production curtailment imposed by the Ministry's affiliated companies (SOC, MOC & MdOC) because of the limitation in the storage and exporting capacity. Of course very small amount of that money was paid as Remuneration Fee compensation to the IOCs according to Article 12.5 of the Contracts. If we take the same assumption of the Fee (3 $lBbl), this may be in the order of 400,000,000 $US.
3. The real reason that this issue was raised is to highlight (a) the delay in performing and completing the projects related to the storage and exporting facilities in the south; (b) the small cost of such projects compared with the revenue of the lost production; and (c) to encourage people to do their jobs and assume their responsibilities properly.
I hope that my clarification is clear enough. Also, I hope that you may make the same clarification to your readers.
